Rules and Regulations

  1. Awards Sponsor: The Toyota Never Quit Awards is being conducted by participating dealers (each called a “Participating Toyota Dealership”), and Toyota Canada Inc. represented by the Toyota Dealer Advertising Association - Prairie Zone (the “Awards Sponsor”).  The Awards program commences at 12:01 a.m. MST on June 12, 2009, and closes at 11:59 p.m. MST on September 15, 2009 (the “Awards Period”).  The Prairie Zone includes:  the provinces of Alberta, Saskatchewan and Manitoba;  the City of Kenora, Ontario and its immediate trading area;  and the cities of Cranbrook and Dawson Creek, British Columbia and their immediate trading areas (as outlined by Toyota Canada Inc.) (collectively, the “Prairie Zone”).

  2. Eligibility: This Award program is open only to persons (this pertains to both nominators and nominees) who are residents of the Prairie Zone who, at the time of entry, have reached the age of majority in the Province in which they reside except employees (and persons with whom such employees are domiciled) of Toyota Canada Inc., its dealerships, and their affiliated companies, advertising and promotional agencies. No self-nominations allowed. A person may be nominated to win one of either the Community Awards or Individual Awards.

  3. How to Enter: No purchase, vehicle test drive or service is necessary to nominate or win any of the Awards. In order to nominate someone, an eligible nominator may obtain a nomination form by visiting a Participating Toyota Dealership during the Award Period or available online at www.toyotaneverquit.com, or by picking up a nomination form at one of the events sponsored by the Awards Sponsor. The list of sponsored events will be available on the website. A nomination form must be completely filled out by someone other than person being entered for the award and received no later than 11:59pm MST on September 15, 2009.  A nominator can only nominate a nominee once.

    There are two categories of entries eligible to win an award: Community Award for contribution to community and dedication to making their community a better place to live and Individual Award for individual tenacity in overcoming adversity and working towards a personal goal.

  4. Winner Selection: The Awards Sponsor will identify a total of six winners for the Toyota Never Quit Awards. The winners will be selected by a panel of three judges on the basis of the Judging Criteria listed below for each category.

    The winners for the Individual Award will be chosen on the basis of the following criteria weighted equally: The magnitude of setbacks they’ve had to overcome, their commitment to improving their quality of life and how passionate their references are about them.

    The winners for the Community Service Award will be chosen on the basis of the following criteria weighted equally: Their commitment to improving the quality of life of those around them, the magnitude of their involvement within their community and how passionate their references are about them.

    There will be two winners (one for the Community Service Award and one for the Individual Award) from each region:

    a.    Alberta (including Dawson Creek, BC and Cranbrook, BC)
    b.    Saskatchewan
    c.    Manitoba (including Kenora, Ontario).

  5. Prizes: Each Award winner will receive a $1,000 cash prize awarded in the form of a cheque. Toyota will also donate $1,000 on behalf of the winner to a recognized charity of the winner’s choice. Each winner will also receive a trophy. No tax receipt will be issued to the winner.

  6. Notifying Selected Award Winners: Each Award winner nominee will be contacted by telephone within one week after the selection takes place. Individual winners may be disqualified if (a) she/he cannot be reached after a reasonable effort to do so has been made; or (b) the Awards Program Sponsor determines that the qualifying nominee is ineligible according to these rules and regulations; or (c) that person does not comply with the rules and regulations of this awards program; or (d) if hers/his prize notification is returned to the Awards Program Sponsor as being undeliverable. Nominators will not win any prizes.  Arrangements for receiving the prizes will be made directly with each winner. All award prizing must be redeemed by December 31, 2009

  7. Correspondence and Communication: All correspondence and communication with nominees in connection with this program will be by email or telephone, except as otherwise noted. Nominees agree to abide by these rules. The decision by the panel of judges shall be final and binding in all matters related to the awards program. The awards program is subject to all applicable federal, provincial, and municipal laws and is void where prohibited.

  8. Releases: By entering or claiming or accepting a prize in this awards program, each nominator/nominee consents to the use of her/his name, voice, picture (both moving and still) or likeness, without compensation, for promotional and/or publicity purposes as determined by the Awards Program Sponsor. Each prize winner agrees to release the Awards Program Sponsor, its assignees, affiliates and associates named in the release from any and all liability, claims or actions of any kind whatsoever for injuries, damages or lost persons and property which may be sustained in connection with the receipt, entry for or use of the prizes.

  9. No Liability: The Awards Program Sponsor reserves the right to change the terms of this program, suspend or cancel it at any time without liability on the part of the Awards Program Sponsor and without prior notice. Awards Program Sponsor shall not be liable for late, lost, stolen, damaged, incomplete, misdirected, mislaid, illegible, or unintelligible entries. If, in the opinion the Awards Program Sponsor, the administration or integrity of the program is compromised or corrupted at any time, the Awards Program Sponsor reserves the right to modify, suspend, or cancel the program.

  10. References to Other Trade Names: The Awards Program website may contain references to other company, brand and/or product names. The company, brand and/or product names are used for identification purposes only and may be trademarks of their respective owners. The images of people or places displayed, forms, structures and graphics displayed or found within the website are either the property of or used with permission of Toyota Dealers Advertising Association – Prairie Zone. Toyota Dealers Advertising Association – Prairie Zone may be, but is not necessarily sponsored by or affiliated with any owners of the other company, brand and/or product names appearing on the website and makes no representations about them, their owners, their products or their services.

  12. List of Award Winners: For names of the Award Winners, mail a self-addressed stamped envelope for receipt by December 31, 2009 to: Toyota Never Quit Results, c/o Venture Communications, 411 – 11th Avenue SE, Calgary AB, T2G OY5.
